PLEASE READ THESE CONDITIONS CAREFULLY, WHEN YOU MAKE A RESERVATION YOU ARE ENTERING INTO A LEGALLY BINDING CONTRACT THE TERMS OF WHICH ARE SET OUT IN THESE CONDITIONS.
If anything is unclear, please contact us so we can explain in further detail to avoid any misunderstandings.
Within the text below, ‘you’ refers to you the customer/client, and ‘we’ and ‘us’ refers to us the owners of Pebble Cottage. A contract between you and us will come into existence when payment is received and a booking confirmation is issued showing the confirmed holiday dates. The contract binds you & all the members of your party. It is your responsibility to ensure that all members of your party accept the terms of the contract set out in these terms & conditions of booking. Failure to disclose all relevant information or comply with these terms may lead to termination of the contract & loss of the booking.
We strongly advise you to take out comprehensive travel insurance to cover cancellations. If you choose not to, then you accept responsibility for any loss that you may incur due to a cancellation mad
Making a booking
All bookings must be submitted by you to us using our standard booking form.
In the event that we decline an application, the full amount of the booking fee will be refunded to you. If an application is accepted, the booking fee will be retained by us and treated as a payment on account of the total amount payable in respect of the letting.
Even if we have sent a written confirmation, we have the right to cancel a booking where there are reasonable grounds to believe that (i) it is not legitimate; (ii) you are likely to breach these booking conditions; (iii) information supplied by you in relation to your booking is incorrect; or (iv) you have behaved in a vexatious, abusive or unlawful manner to us. If we cancel your booking in these circumstances, we will tell you in writing and we will not have any further legal or financial responsibility to you. Bookings cannot be accepted from persons under eighteen years of age. The owner reserves the right to refuse a booking without giving any reason.
Payment
The amount of the booking fee shall be as follows:
1. If the booking fee is submitted 10 weeks or more before the commencement of the requested holiday letting period, 25% of the full amount is payable in respect of the letting; or
2. If the booking form is submitted less than 10 weeks before the commencement of the requested holiday period, the full amount is payable.
A refundable £100 damage deposit is also required but will be returned subject to breakages/damage. Any such deduction will be reasonable and evidenced by the owner.
If the balance is not received by the due date (10 weeks prior to the holiday), then your holiday will be treated as a cancellation and the you will remain liable to pay the balance of the payment.
Conditions of stay
Arrival and departure
You can arrive at your accommodation at any time after 4pm on the start date of your rental period. You must leave by 10am on the last day. If you fail to arrive by 12 noon on the day after the start date of your rental period and you do not let us know that you are arriving late, we may treat your booking as having been cancelled by you. In this situation, you may not be refunded any money you have paid. If you fail to leave by 10am, we may charge a further day's rental, on a pro-rata basis.
On checkout, please;
· Leave used towels in the bathtub.
· Empty the bins to the bin store.
· Empty fridge and remove any opened and perishable food.
· Wash and put away any dirty dishes or load the dishwasher.
· Turn off the lights.
· Close windows and lock the doors.
· Leave the door keys in the key safe.
During your stay
This property is privately owned and is also our home. We expect all guests to enjoy the facilities and treat the property with the same respect that they would with their own house. You and all members of your party agree to keep the accommodation clean and tidy, and to leave the accommodation in a similar condition as you found it when you arrived.
All inventory must remain in the property and not be taken to another property. We keep a kitchen inventory list in the property so that you know what we have for your use.
Please lock the doors and close the windows when you leave the property unoccupied.
Please make sure you switch off lights, heating or any electrical appliances when you go out – we’re an eco-friendly holiday home.
Please don’t take any bath towels with you to the beach.
Please note that if any keys issued are not returned at the end of your stay, then the cost of replacement will be charged to you.
Barbecue – please use the designated barbecue utensils and you must clean the barbecue after use.
Unreasonable behaviour
We can refuse to hand over the accommodation if the unreasonable behaviour of anyone in your party is likely to cause offence to our neighbours or their guests, or if we have reasonable cause to believe you or any member of your party will cause damage or loss to the accommodation, its services or facilities. If this happens, the contract between us will end and you will not receive any refund and we will have any further responsibility to you.
We can end a stay after the keys have been handed over, if the unreasonable behaviour of anyone in your party (including anyone invited into the accommodation by you) is likely to spoil the enjoyment, comfort or health of other residents, neighbours or members of staff or where you or any member of your party (or anyone invited into the accommodation by you) has broken or is likely to break any of these booking conditions. If this happens, you will have to leave the accommodation immediately and no refund will be given. You may also be responsible for any costs we incur as a result of your behaviour.
Please respect the local community and try to keep noise levels to a minimum, especially between 11pm and 8am.
Fire hazards
When the wood burner is lit, use the fire guard. Make sure the fire is extinguished before going to bed or leaving the property. To maintain the efficient operation of the wood burner and flue pipe, please only use seasoned wood, do not burn any other materials. Never leave the fire unattended. The use of candles inside or outside Pebble Cottage is strictly prohibited. Turn off all electrical appliances before going to bed and close all doors.
Use of the property
You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the booking period, does not create the relationship of Landlord and Tennant between the parties. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or Protection from Eviction Act 1977 or other statutory security of tenure now or at the end of the Holiday Period.
You may in no circumstance re-let or sublet the property, or allow use by third parties, even free of charge.
Maximum occupancy
The maximum number of persons using the accommodation at any time must not exceed 6 persons and only those listed on the booking form can occupy the property. You cannot arrange for visitors to the accommodation without the advance consent of us. You must not hold events (such as parties, celebrations or meetings) at the accommodation without the advance consent of us.
If you do any of these things, we can refuse to hand over the accommodation to you or can repossess it. If we do this, we will treat this as you are cancelling the booking. In these situations, you will not receive a refund of any money you have paid for your booking. We will not be legally responsible to you as a result of this situation (for example, for any costs or expenses you have to pay due to not being able to stay in the accommodation, such as the cost of finding alternative accommodation). We are not are under any obligation to find any alternative accommodation for you.
Pets
Pets are allowed when agreed at the point of booking. If pets are agreed, you are wholly responsible for the supervision and behaviour of your pet at all times. If we agree for you to take a pet, you must:
· not allowed pets upstairs on beds
· please ensure that any pet is clean and dry inside the property
· bring pet bedding and towels required as we do not supply these
· not leave any pets unattended in the accommodation, including the garden
· not leave children alone with any animal
· ensure that pets behave in such a manner as not to disrupt the enjoyment of other people living or staying in the vicinity
If you or any member of the party has a pet allergy, we cannot guarantee that dogs, or other pets, have not stayed in the cottage, nor can we accept any responsibility for any subsequent health reaction. It is your responsibility to make specific enquiries before booking.
Smoking and vaping
No smoking or vaping is permitted within the cottage. If additional cleaning or repair is required then this may be deducted from the damages deposit or charged separately.
Damages
Damages and breakages – please treat the facilities & accommodation with due care so that other guests may continue to enjoy them. If you notice something is missing or damaged in the cottage, please let us know immediately so that we can take the appropriate action. If there has been any damage or breakages during your stay, we would be grateful if you could report them promptly, especially before check-out. The accommodation will be inspected by our cleaning staff at the end of the holiday & you may be charged for any loss or damage.
In making a booking you accept responsibility for any theft, breakage or damage caused by you, your pets or any member of your party and agree to indemnify us in full for any loss that we may incur as a result. A security deposit of £100 is required before your arrival at Pebble Cottage. This amount is fully refundable within 2 weeks of your departure, providing the property is left clean and tidy, that there have been no breakages, extra cleaning required or any extra people found to be staying at the property. In the event that you or anyone staying at the property during your reservation period causes damage or incurs a need for professional cleaning services or leaves the property without settling invoices for additional services or supplies received during your reservation period you will be notified in writing of the details of any extra costs incurred within 14 working days after the end of the reservation period and this amount shall be deducted from the damage deposit, if the required sum exceeds the damage deposit then additional payment will be required by you.
We reserve the right to make a charge to cover additional cleaning costs if you leave the property in an unacceptable condition.
Right of Entry
We are allowed to enter the accommodation (without letting you know first if this is not possible) if special circumstances or emergencies happen (for example if repairs need to be carried out) or if you break any of these booking conditions or any other terms that apply to your booking and/or the accommodation.
We or our representatives are allowed to enter the accommodation to inspect it (including but not limited to where you have complained about the accommodation). If this happens, you will be given reasonable notice first.
You agree to allow us or our representatives (including workmen) access to the accommodation as required by this clause.
Cancellations
All cancellations must be notified in writing. If you cancel your holiday more than 10 weeks before it is due to start, then your initial booking payment will be forfeit. If you cancel less than 10 weeks before the holiday, then the full balance remains due and is not refundable.
Your booking will not be cancelled by us except in exceptional circumstances beyond our control. Notification will be given of the cancellation as soon as possible and we will promptly refund all payments made for your holiday. Our liability for cancellation will be limited to payments made to us.
If you or any member of your party has any medical problem or disability that may affect your booking, please tell us before you confirm your booking and give us full details in writing as early as possible before you travel. If we are unable to make reasonable adjustments to meet that person’s particular needs, we can refuse or cancel the reservation.
Cancellations due to government public health measures for Covid-19
If you have to cancel your booking because UK government public health measures imposed as a result of the Covid19 pandemic mean it is unlawful to travel to or to make use of the accommodation you booked, you may choose to (i) transfer your booking to a later date free of any administration charges, subject to availability - you will have to pay any difference in price if the cost of the new booking is higher or be reimbursed the difference if the cost of the new booking is lower, or (ii) obtain a refund of the amount already paid by you for the booking. You will have to contact us in order to access these options.
Part-Cancellations
If any person(s) in your party needs to cancel, this will not affect the total cost of your booking. No refunds are payable in the event that you cut short your stay.
If we cancel your booking or are prevented from providing the accommodation you have booked, you may choose to (i) request a voucher with a redemption value equal to the amount previously paid by you for the booking, or (ii) obtain a refund of the amount already paid by you for the booking. We will contact you to inform you of these options.
Complaints
Any problem or complaint which you may have concerning your stay must be immediately reported and we will endeavour to put matters right. Any complaints not reported to us at the time and only reported after the you have returned from stay cannot be considered by us.
Force Majeure
Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation, if our contractual obligations to you are affected by “Events Beyond Our Control”. For the purposes of these Booking Conditions, Events Beyond Our Control means any event beyond our or the Owner’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination (including epidemics, pandemics and the ongoing effects of the Covid-19 pandemic) or natural disasters such as floods, earthquakes or weather conditions which prevent you from travelling to the travel destination and/or make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our control.
Liability
We shall not be liable for loss of profits; loss of business; loss of anticipated savings; loss of personal property or possessions; loss of use of the property or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses in respect of the reservation. We are not responsible for the loss of any personal belongings or valuables of the guest. Any vehicle of yours or any third-party making use of the property during the period of your reservation is left at the property entirely at the risk of the owner of the vehicle.
Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of the conditions of this agreement shall be limited to the monies paid in respect of your reservation under the conditions of this agreement.
We shall not be liable for any temporary defect or malfunction of any equipment, machinery or appliance in the building or grounds. Please do contact us and we will make every reasonable effort to rectify the situation.
No compensation will be given for any temporary outage of electricity, gas, water, internet connection or television service.
Guests are responsible for the safety and security of their children at all times. Never leave children in the property without adult supervision.
We cannot be held responsible for noise or disturbance which comes from beyond the boundaries of the accommodation or which is beyond our control. If we know about a problem before you arrive, we will contact you to let you know.
Changes to these terms
No representative or agent has the authority to vary, amend or waive any of these booking conditions. No amendment, variation or waiver of any of these booking conditions will be valid or have any effect unless accepted by us in writing.
In the event of any conflict between these booking conditions and any other contents of any brochure or website, these conditions shall prevail.
We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.
